By sharing your video, audio, photo, or written story, you help empower others navigating a cancer diagnosis with clear, relatable insights. This Media & Recording Consent Agreement outlines the terms of your voluntary submission and details how TPS may publish, edit, and share your contributed materials to fulfill our mission of education and empowerment.

1. Agreement to Terms & Submission

By checking the agreement box and submitting your content—whether in the form of video recordings, audio files, photos, or written text responses (“Contributed Materials”)—you (“Participant”) acknowledge that you have read, understood, and agreed to the terms of this Media & Recording Consent Agreement with The Patient Story (“Company”).

2. Grant of Rights

For consideration which you acknowledge, you hereby grant The Patient Story and its assigns, licensees, and successors the right to copy, reproduce, edit, publish, distribute, and use all or a portion of your Contributed Materials and associated statements. This includes incorporating your submission into written, audio, digital, and video content (“Works”).

3. Scope & Distribution

This consent permits the use of your Contributed Materials in the Works across all forms and media, including social media, websites, promotional campaigns, and educational materials throughout the world, in perpetuity, and irrevocably (subject to Section 9). You grant The Patient Story the right to edit, reproduce, and display your name, image, voice, likeness, and story, and you waive the right to inspect or approve any final versions.

4. Commercial Scope

Further, you understand the Works may be used in printed or digital media distributed to the public, so long as these materials will not be used by The Patient Story for the sales of any product outside of its mission of education and empowerment. This applies to all automated submissions provided to The Patient Story ongoing, including future Works.

5. No Financial Compensation

You acknowledge and agree that you are providing your Contributed Materials voluntarily for educational, empowerment, and storytelling purposes. You will receive no monetary compensation, royalties, or financial remuneration of any kind for your submission or its public use.

6. Ownership & Originality

You confirm that to the best of your knowledge, you have full ownership rights to all Contributed Materials you submit (including text, photos, audio, and video) and that such content is not owned or copyrighted by any third party. You also confirm that you have obtained all necessary permissions for any individuals (family, caregivers, friends) who appear in your photos, video, or audio uploads. You agree to indemnify and hold harmless The Patient Story from any claims arising out of third-party appearances or ownership disputes.

7. Production Ownership

The Patient Story shall have full and exclusive ownership of any final media or promotional materials it produces incorporating your Contributed Materials, while you retain original ownership of your submitted files. The Patient Story is not obligated to utilize the rights granted under this Agreement.

8. Personal Health Information (PHI) Release

You acknowledge that during your submission, you may voluntarily disclose personal health information, medical history, diagnosis, treatment details, or personal health experiences (“PHI”). You understand that The Patient Story is a media organization and is not a HIPAA-covered entity. You hereby grant permission to The Patient Story to record, publish, and share this PHI as part of the Works for public educational and storytelling purposes. Once published, this information will become publicly accessible and is no longer subject to medical privacy restrictions.

9. Request for Anonymization

While this permission is intended to be irrevocable, you may contact The Patient Story in writing to request reasonable efforts to limit future use or anonymize certain materials. You acknowledge that full removal may not be possible once materials have been distributed or published, but that The Patient Story will make a good-faith effort to accommodate such requests when feasible.

10. Capacity & Authority

By submitting your Contributed Materials, you confirm that you are at least 18 years of age, of sound mind, and providing this consent freely without duress or undue influence.
